Review of the Cemeteries Act

The Department of Local Government and Community Services is reviewing the Cemeteries Act to ensure legislation remains relevant and up to date.

The Cemeteries Act and Cemeteries Regulations establish the legislative framework for the administration and operation of the cemetery and crematorium system in the Northern Territory. 

The legislation:

  • governs the establishment, maintenance and control of cemeteries
  • regulates the time, manner and place of burials, cremations and exhumations.

Public discussion paper

On 7 December 2012, the Department released a public discussion paper on the review of the Cemeteries Act. 

In addition to the submissions received, further research has been undertaken into various cemeteries legislation and other practices across Australia.

Position paper 

This position paper sets out the fundamental matters that are expected to be included in a new Cemeteries Act.
